Urgent: Provide Input Now on SB 10 Implementation

Dear Friends of UC,


This Thursday, August 3 at 9:00 a.m., the Planning Commission will conduct the second hearing on the Housing Action Package 2.0, which includes a component to adopt SB 10 in San Diego. SB 10 is state legislation that allows development of apartment buildings of up to 10 units on single family lots located within Sustainable Development Areas (areas within one mile walking distance of a current or planned major transit stop). San Diego’s one-mile designation of walkability exceeds almost all other government agency definitions, allowing for significantly more development and density. Another important SB 10 fact is that the legislation states that once a local jurisdiction (such as a City Council) adopts plans under SB 10, future City Councils cannot change, modify or revoke those plans. The Planning Commision considered adoption of SB 10 on June 1. Many Commissioners expressed concern over the scope of the plan, and thus the matter was rescheduled to August 3 for further consideration. In response, the Planning Department prepared a memo to the Planning Commission (dated July 25, updated with minor revisions on July 27) which provides 3 options for the Planning Commission to consider in addition to the original plan for SB 10 implementation.

  • Original proposal: Allows SB 10 development within 1 mile walking distance of existing and planned major transit stops. (This includes the intersection at Governor and Genesee.)

  • Option 1: Allows SB 10 development within ½ mile walking distance of existing major transit stops. This excludes South University City.

  • Option 2: Allows SB 10 development within ½ mile walking distance of existing major transit stops and ⅛ mile walking distance of existing High Quality Bus Corridor Stops. This would include properties within ⅛ mile along Genesee Avenue.

  • Option 3: Allows SB 10 development within ½ mile walking distance of existing and planned major transit stops. This includes properties up to ½ mile walking distance from the Governor and Genesee intersection.


These proposals also include a reduction in the total number of units that could be built, with a cap of one unit per 1,000 square feet of lot area. While the potential reduction in the number of units per square foot is encouraging, other details are concerning. What Can You Do?

We strongly encourage the community to provide input to the Planning Commission on these proposals. Now is the time to let the Planning Commission know what you think about these proposals and SB 10 implementation in general. Written public comments can be submitted via the webform and are due no later than 7:00 am on Thursday, August 3. To use the public comment webform:

  • Click here to go to the WEBFORM

  • Choose the meeting date: August 3rd, 2023

  • Check "Agenda Comment," then add: "Item 2 - HAP 2.0"

  • Check: "In Opposition to Item"

  • Check box if you would like to speak on the item during public testimony

  • Type your comment (200 words or less) in the comment box.


If you want to speak at the hearing, you can attend in person (the hearing is at the City Administration Building, 202 C Street, 12th Floor, and fill out and turn in a speaker form before they begin the hearing on this item), or you can attend by Zoom.

When the hearing begins, they usually provide instructions on how to comment over Zoom, which usually involves raising your hand or typing your name in the chat that you would like to comment (either for or in opposition to) the item. We encourage everyone in the community to let the Planning Commission know your opinion on this development proposal.
